Non-Exempt Employee Work Hours Training
Dear Supervisors and Non-exempt Employees,
The implementation of MyTime has raised many questions about what it means to be or supervise a non-exempt employee at UMW. To begin to address these questions we are offering this 20 minute course, Overtime Compensation Requirements, to help you understand the federal FLSA (Fair Standard Labors Act) and state policy requirements for compensating and managing hours of work for non- exempt employees. All Supervisors, including those who supervise student employees, are required to complete this course by June 30. Non –supervisory employees are strongly encouraged to participate. Instructions to access the course in UMW Global are provided are attached and also embedded below.
At different times within the presentation you will be directed to UMW for its specific application of federal law and state policy. Please note the following:
- The UMW standard workweek is 12:01 a.m. Monday through midnight on Sunday.
- UMW currently uses only OT pay to compensate non-exempt employees for hours worked beyond 40 in a work week. The use of OT leave in lieu of OT pay is under review.
- UMW counts hours worked to the nearest quarter of an hour ( 15 minutes).
- AT UMW overtime pay or straight time compensatory leave is authorized only for exceptional requirements of an emergency or temporary nature. The earning of either to satisfy routine agency or departmental requirements is prohibited. While this policy provides management with the prerogative of determining when and how much overtime pay or compensatory leave can be earned, supervisors are responsible for controlling the work hours of all employees.
- UMW permits paid 15 minutes break twice a day.
The University is required to comply with all laws governing the pay of non-exempt employees for hours worked. Employees are encouraged to contact Terri Lockhart, Employee Relations, at tlockhar@umw.edu or ext2051, with any concerns about university compliance.
Classified positions in Bands 3 and 4 will be reviewed for exempt/non –exempt FLSA status beginning in August in conjunction with the opening of the Classified Employee Performance Management cycle for 2015-16.
If you still require Supervisor or New User MyTime training, MyTime training classes are offered Monday, Wednesday and Friday between the hours of 10am to 12pm or Tuesdays and Thursdays between 3 and 5pm. Registration is required, please contact TESS@umw.edu.

Board of Visitors Announces Presidential Search Advisory Committee
The following message is from the Office of Media and Public Relations:
Rector Holly Cuellar announced at the May 8 meeting of the Board of Visitors the formation of the presidential search advisory committee for selection of the 10th president of the University of Mary Washington. “Appointment of a president is the most important duty of the Board of Visitors.” Cuellar said. “And we take our role very seriously.” The selection committee will do initial screening, vetting, and interviewing of candidates, then recommending to the full Board a select group of finalists. Your UMW Benefits Team will conduct an open enrollment informational session on each Campus:
Fredericksburg – Tuesday, May 12 at 10:00 am in Lee Hall, Room 412
Stafford – Thursday, May 14 at 3:00 pm in the North Building, Room 114
Dahlgren – Thursday, May 14 at 1:00 pm
Open Enrollment for health care and flexible spending accounts (FSAs) begins on Friday, May 1 and continues through Friday, May 22, 2015. This timeframe is your opportunity to enroll in a health plan, change your health plan, add or remove family members or waive state health coverage without a qualifying reason (eligibility documentation is required for dependent coverage) and it is the annual enrollment for Flexible Spending Accounts.
There are a few changes to our health insurance plans this plan year, please be sure that you understand all of your options before making your open enrollment election. More flexibility with receiving Premium Rewards. Annual Enrollment is required for participation in the Flexible Medical or Dependent Spending Accounts. Please note the maximum contribution to a Medical FSA has increased to $2, 550 and failure to resolve FSA card transactions on time will result in withholding that amount from your paycheck.

Two Options to Make Changes and/or Enroll:

EmployeeDirect has been enhanced and updated. EmployeeDirect changes are accepted until 11:59 pm on Friday, May 22, 2015.
Paper Enrollment Form – http://www.dhrm.virginia.gov/docs/default-source/benefitsdocuments/OpenEnrollment2015/stateactiveenrollform2015.pdf?sfvrsn=2 (Section 3 – Flexible Spending Accounts and Section 4 Health Care Coverage). Enrollment forms must be forwarded and received in Office of Human Resources on or before 5 pm on Friday, May 22, 2015 to be effective July 1, 2015.
The Premium Reward Program will continue for the 2015-2016 plan year. The program is only available to employees, retirees and their spouses enrolled in COVA Care or COVA HealthAware. The requirements have not changed—completion of an online health assessment and biometric screening. Each can be access by creating an account with www.myactivehealth.com You can confirm your participation in the Premium Reward Program by logging into your EmployeeDirect account.
- For those enrolled in either COVA Care or COVA HealthAware on or before July 1, 2015 and currently receiving the premium reward:
- Both (employee and enrolled spouse) are required to update their online health assessment no later than June 30, 2015 to continue receiving the premium reward without a break. The reward will continue through the plan year, as long as you are enrolled in one of the plans. Biometric Screening is not required.
- 2. For participants who are enrolled in either COVA Care or COVA HealthAware and are NOT currently receiving the premium reward:
- Participant and/or enrolled spouse must complete both requirements by June 30, 2015, in order to start receiving their premium rewards effective July 1, 201 The reward will continue through June 30, 2016, as long as enrollment in one of the plans continues.
New: If the requirements are not completed by June 30, 2015, eligible members can complete the online health assessment and or the biometric screening during the plan year and the Premium reward will be effective the first of the month after both requirements are completed, submitted and accepted.

Message from the President
The following message is from President Rick Hurley:
I wanted to take this opportunity to explain what took place on campus the morning of Thursday, May 7. You may have seen news coverage about the event. Yesterday, we received a media advisory about a press conference being held on the steps of GW Hall. The conference, organized by the Feminist Majority Foundation, was to announce the filing by members of Feminists United and other students of a Title IX sex discrimination complaint against the University. While we disagree with many of the details and content in this morning’s press conference, we do share the ultimate goal of maintaining a safe environment for the entire campus community.
Let me make this clear: This University takes any allegation of gender-based violence very seriously. And, as some of you are aware, the administration has been actively engaged throughout the academic year with members of Feminists United and other students to address issues of safety and campus culture. Creating a safe learning and living environment is our first and foremost concern and I am pleased with the outpouring of students’ support shown today about how safe they feel on campus.
The University will cooperate fully with the Office of Civil Rights regarding the concerns put forward in the Title IX complaint announced today.

Note: If a decal was requested and received after Jan. 6, 2015, it is the new decal (oval shape) and is valid thru July 1, 2017. Once a new decal has been issued for a vehicle, the old decal will be invalid.
